Ward, Smith & Hill Attorneys Successfully Navigate Breach of Contract and Indemnification Suit on Behalf of Local Business Owner

LONGVIEW, Texas – Ward, Smith and Hill attorneys Brett Miller and Garrett Parish successfully navigated multiple procedural hurdles to obtain a favorable result for local business owner, Kevin Curbo. Mr. Curbo owns and operates Quality Truck Accessories in Longview, Texas and is the former owner of Longview Drive Shaft and 4X4 Shop, which he sold in 2019.

In September 2022, Ring & Pinion Service, Inc. (a vendor) sued Longview Drive Shaft and Mr. Curbo for debts incurred by the company after the 2019 sale. Ring & Pinion Service, Inc. sought to hold Mr. Curbo liable based on a guaranty agreement that he signed on behalf of Longview Drive Shaft back in 2015. Facing liability in excess of $150,000, Mr. Curbo denied the Plaintiff’s claims and filed indemnity claims against Longview Drive Shaft and its new owners.

Thanks to several key procedural plays by Mr. Miller and Mr. Parish, Mr. Curbo settled with the Plaintiff for $20,000 and obtained a default judgment for indemnity against Longview Drive Shaft and its owners.  Ultimately, Longview Drive Shaft and its owners reimbursed Mr. Curbo for the $20,000 he paid to settle with the Plaintiff, plus approximately 95% of his attorney’s fees from the litigation.
